Terms of Service

1. Acceptance of Terms

By creating an Olemhe account or using the Service, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use Olemhe.

2. Service Description

Olemhe provides an AI-powered commerce automation platform that enables merchants to accept orders via Facebook Messenger, Instagram Direct Messages, and WhatsApp. The Service connects to your social media accounts and e-commerce store (Shopify, WooCommerce, Bumpa, or REST API) to automate order-taking conversations using an AI agent.

3. Subscriptions and Billing

  • Plans are billed monthly or annually as selected at signup.
  • All plans include a 7-day free trial. No card is charged during the trial period.
  • After the trial, your payment method is charged automatically on the billing date.
  • You may cancel at any time from Dashboard → Billing. Cancellation takes effect at the end of the current billing period; you retain access until then.
  • No refunds are provided for partial billing periods.
  • Nigerian merchants are billed in NGN via Paystack. All other merchants are billed in USD via Stripe.
  • Plan limits are measured by completed orders per month (Starter: 50, Pro: 250, Growth: 800, Enterprise: unlimited). Exceeding your plan's limit pauses new order processing until the next billing cycle.

4. Meta Platform Compliance

Olemhe uses the Meta Platform (Facebook, Instagram, WhatsApp Business API). By using Olemhe you agree to comply with:

You must not use Olemhe to send spam, unsolicited messages, or violate any platform policies. You are responsible for obtaining any required permissions from your customers to message them.

5. Your Responsibilities

  • Ensure your store's product information is accurate (prices, stock, descriptions)
  • Fulfill all orders placed through Olemhe promptly and in accordance with your store's policies
  • Keep your API credentials and access tokens secure
  • Not use the Service to sell prohibited, illegal, or dangerous items
  • Comply with all applicable laws in your jurisdiction, including consumer protection and data privacy laws

6. Limitation of Liability

Olemhe is provided "as is." We make reasonable efforts to maintain availability but do not guarantee 100% uptime. We are not liable for:

  • Failed or missed orders due to store downtime or connectivity issues
  • Incorrect responses generated by the AI agent
  • Revenue losses resulting from service interruptions
  • Actions taken by Meta that affect your account (bans, restrictions, policy changes)

Our maximum liability for any claim is limited to the fees paid in the preceding 30 days.

7. Intellectual Property

Olemhe and its AI agent are owned by us. You retain ownership of your store data, product catalog, and customer data. By using the Service, you grant us a limited license to process your data to provide the Service.

8. Termination

We may suspend or terminate accounts that violate these Terms, Meta platform policies, or applicable law. You may cancel your account at any time from the billing settings page. Upon termination, your data is retained for 30 days before permanent deletion.

9. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email. Continued use of the Service after changes constitutes acceptance of the updated Terms.
